TERMS AND CONDITIONS

 

1 - AGREEMENT


. Buyers must be over 18 years old and have full legal capacity.
. By accepting the Terms and Conditions when confirming your order, you confirm your absolute taking of these Conditions.
. In deciding whether to accept your order we may carry out a credit check and then will only accept your order if we are satisfied with the results of such a check. You confirm that you agree to us carrying out such a check.
. We reserve the right to modify this agreement. The Agreement in force at the time an order is accepted will govern any particular order. In the event that we make any amendment to this Agreement which is materially to you, we will ensure that the amendment does not become affective for at least one month after the change is made.
. These conditions can be printed by all users of our Website. Whilst they remain posted on our Website, these Conditions will apply to all transactions carried out via our Website.

 

2 - ORDER

. To place an order, you should select the require item(s) and add to your basket on the “buy this product” link. You can review the selected item(s) at any time by clicking on the “basket” link. Once you have completed your shopping, please click on the “Proceed to payment” link.
. You must confirm your delivery address to access the purchase order, which contains a summary of the information related to the item(s) ordered, quantity, price, total and your other details along with the delivery address. It is your responsibility to notify us if any of the information is incorrect. Giving false information may result in the rejection of the order.
. Each order constitutes a separate transaction and we are not able to consolidate separate transaction into a single order or delivery. If you would like
to order multiple items for delivery at the same time, you must ensure that all of these appear on the same order before you confirm your order.
. Your placing of an order is an offer by you to purchase an item and is subject to acceptance by us. Orders shall be accepted at our sole discretion but are normally accepted if the item(s) is/are available, the order reflects current pricing, you are based in a country to which we are currently able to sell/deliver and your credit/debit card is authorized for the transaction.
. In the event that an item is out of stock, you will be informed as soon as practically once we are made aware by our tannery. The order relating to the unavailable item will be cancelled and a full refund will be made including any delivery charges. Where your order is for multiple items, the rest of the order will remain valid.

 

3 - PAYMENT

. All the items are priced in Euro and are exclusive of any customs and import charges applicable to your delivery address.
. You must pay for the items prior to their dispatch to you by credit card. The following Credit Cards are accepted: Visa, MasterCard and American Express. Our Bank Credit Agricole is partner with PAYBOX, an online payment module that secures your transaction.
. Once you have reviewed your order and provided the required personal details, you will be required to click on “Checkout” to pay by Card. Payment by card will be processed through the electronic payment terminal of the Bank Credit Agricole. The Bank Credit Agricole website is secured by SSL (Security Socket Layer), an accredited certification service provider, to protect the confidential details provided for payment. The User’s payment details are transferred directly to the Bank, which also operates under the secure SSL encryption.
. PayPal. Uncontested on-line payment leader, allows the buyers to send on-line payments. PayPal counts more than 100 million accounts and regions of the world. It is accepted by the traders everywhere.
PayPal contributes to protect the information concerning your Credit Card thanks to the best systems present on the market for the security and the fraud prevention.
For payments by the PayPal system, the financial information is never communicated with the trader.
. Transfer payment. You will receive STEPHAN HELLEC Bank details to make your payment in the e-mail confirming the reception of you order. We don’t accept payment by Credit Card if it comes from a country which does not use 3D SECURE. 3D SECURE is an XML-based protocol designed to be an additional security layer for online Credit and Debit Card transactions. A transfer payment is then recommended.
. Your credit card will be debited at the time the order is prepared. You must confirm to us the name which appears on the credit card to be debited, give the 16-digit card number and the expiry date as shown on the front of the card, as well as the security code on the reverse of the credit card. We undertake to keep this information strictly confidential. Once the payment has been accepted, the order cannot be amended. We will confirm receipt of your order to the email address you provide at the time of registration. It is recommended that you retain email or print out the confirmation of the order.
REASSURANCE
. For payments by Credit Card directly, the information of your Credit Card are encrypted thanks to the SSL protocol (Secure Socket Layer) and never pass through the network unencrypted. The payment is directly made with our Bank.
. For payments by PayPal system, the financial information is never communicated to the trader
. In the event that payment cannot be made, the order will not be processed and will automatically be cancelled.

 

4 - DELEVERY

. All items will be delivered to the address specified in your order once payment has been confirmed. Please note that deliveries are not made outside the hotel or PO Box addresses or to business premises.
. Following the shipment of the order from us, you will receive an email specifying the tracking number for your parcel which you can use to track the parcel on the website of our designated courier.
. We will aim to deliver the items within 10 working days.
. All risk in the items you order (including risk of loss and/or damage to the items) shall pass to you when they are delivered to the delivery address specified in your order.
. You will only own the items once they have been successfully delivered and when we have received cleared payment for them in full. Until that time we will retain title to the items.
. If you are not present at the time of delivery, a delivery note will be left inviting you to contact the courier directly in order to arrange re-delivery at a convenient time.
. If after 15 working days following notification of the tracking number, you have no received the parcel or a delivery note, you must contact us by clicking on the link “contact us” or by responding to one of the confirmation mails of your order. Please specify your order number or invoice number in order to allow us to respond to you at the earliest. If the parcel is found, it will be sent to you immediately. In the rare event that the parcel has been lost, we will refund the total amount of the order.
. We take care extremely well when dispatching orders but we recommend that when you receive your order, you carefully check the item(s). Please give us written notification of some eventual problems within 24 hours of the delivery date. If at the time of delivery, the packaging is damaged, you are required to open the package in the presence of the carrier in order to verify the condition of the items. In the event of damage to the items, you should also note the details on the delivery note and contact us.
. You must return any incorrectly delivered or faulty item(s) to us as soon as possible and at the latest within 10 days of receipt of the item, and we will refund the cost of you.
. We will provide a full refund for a missing item or, where requested by you, we can send a replacement item subject to availability.

 

5 - CANCELLATION AND RETURN POLICY

. You have a revocation period of 14 working days from the delivery of the order executed on www.stephanhellec.com. During this period, you can return, at your expense by courier, recorded or special delivery and without other penalties, the items that are not acceptable. We recommend you obtain and keep proof of postage in case you need it as evidence that you have returned the item(s) to us.
. Returns will be accepted by STEPHAN HELLEC only if you have immediately contacted us by clicking on the link “contact”. The day we received a written notification of some problems, you have 14 days to return the item .The returned items must not have been used, modified, washed or damaged and must still be in their original packaging. You are asked to take reasonable care with the item(s) and in the case of an item with a hygiene seal; you are required not to remove the seal when examining the item. Any worn item(s) can be subjected to no return for nonconformity.
. Please, place the completed “Goods Return Document” in the package with the item(s) you wish to return to us.
. We advise you to return items by recorded delivery or by any other means that shows proof of the return. The return address is listed below for your reference:

. After a good verification, the amounts already cashed will be reimbursed in any event within 30 days. No refund will be offered for items that are returned by the Customer incomplete, damaged or soiled. You must take reasonable care of the items if you wish to return them exercising your consumer rights.

 

6 - LIABILITY

. STEPHAN HELLEC would not be blamed for the non-fulfilment of the concluded contract because of case of absolute necessity, such explosion, flood, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work. The choice and the purchase of a product are placed under the responsibility of the customer. The impossibility to use the products in particular because of incompatibility can give rise to no compensation, repayment or questioning of STEPHAN HELLEC responsibility, except in the case of proven latent defect, nonconformity, imperfection or exercise of the right retraction mentioned at article 5.

 

7 – VERIFICATION PROCEDURE

. In exceptional circumstances, we reserve the right to use a verification procedure to prevent fraudulent use of the website. If required, you will be requested to send us by email a copy of your ID (e.g. passport) as well as proof of your address of the past 3 months. The order will only be dispatched after we have received and verified these documents.
. We reserve the right to cancel an order and carry out a refund in the event of not receiving the documents or not conformity of the document.
. We reserve the right to define the circumstance in which this additional verification will be required.

 

8 – COOKIES

. A cookie is an element of data that a website can send to your browser. If you wish, you can usually adjust your browser so that your computer does not accept cookies. We do not exchange cookies with any third party websites or external data suppliers. The only cookies we use are related to each connection and are deleted at the end of each visit of the website.

GOVERNING LAW
. This agreement shall be governed by and construed in accordance with French law. Any disputes shall be subject to the exclusive jurisdiction of the French court, to which both parties submit.
